1. Service Overview
Every Social Media ("we", "us", "our") provides AI-powered DM automation and booking services for aesthetic and medspa clinics ("you", "your", "Client"). These terms govern your use of our services.
2. Demo Bookings
Demo sessions are free, informational, and non-binding. They allow us to understand your needs and demonstrate how our service works. No commitment is required to schedule or attend a demo.
3. Service Engagement
Formal service engagement begins only after:
- A signed proposal or service agreement
- Payment of the setup fee and first billing period
- Provision of required account access and content
4. Pilot Period
New clients start with a 14-day pilot period:
- Setup fee: £1,900 (non-refundable)
- Pilot fee: £900 (refundable under guarantee conditions)
- Guarantee: If we don't book at least one consultation from your DMs during the pilot, the £900 pilot fee is refunded
5. Ongoing Service
After the pilot, service continues on a monthly basis:
- Monthly fees are billed in advance
- Either party may cancel with 30 days written notice
- Specific monthly fees are detailed in your service agreement
6. Your Responsibilities
To enable us to deliver the service, you agree to:
- Provide accurate service information, pricing, and policies
- Grant necessary account access via official platform APIs
- Respond promptly to escalated enquiries
- Maintain valid payment methods for billing
- Comply with platform terms of service (Instagram, WhatsApp, etc.)
7. Service Limitations
Our service has specific limitations:
- No medical advice: The AI handles logistics and booking, not clinical recommendations
- No outcome guarantees: We don't guarantee specific booking volumes or revenue
- Platform dependency: Service relies on third-party APIs which may change
- Response accuracy: AI responses are based on the information you provide
8. Account Access
We access your Instagram and/or WhatsApp accounts via official APIs only. We:
- Never request or store your passwords
- Use least-privilege permissions
- Remove access promptly upon service termination
- Maintain audit logs of system actions
9. Confidentiality
We treat your business information, client data, and operational details as confidential. We will not share this information except as required to deliver the service or as required by law.
10. Liability
To the maximum extent permitted by law:
- Our liability is limited to fees paid in the 3 months preceding any claim
- We are not liable for indirect, consequential, or punitive damages
- We are not liable for platform outages or API changes beyond our control
11. Termination
Either party may terminate:
- With 30 days written notice for convenience
- Immediately for material breach not cured within 14 days of notice
- Immediately if the other party becomes insolvent
Upon termination, we will remove account access and provide any data you request.
12. Governing Law
These terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales.
13. Changes to Terms
We may update these terms from time to time. Significant changes will be communicated via email at least 30 days before taking effect.
